These Terms and Conditions ("Terms") govern your use of the WorkxPro time tracking platform, including the mobile application and web portal (the "Service"), operated by WorkxPro ("we", "our", or "us"). By accessing or using the Service, you agree to these Terms.

1. Use of the Service

The Service is provided for use by authorized personnel of subscribing organizations. Access is granted through accounts created by your organization's administrators. You are responsible for maintaining the confidentiality of your account credentials and must notify us immediately of any unauthorized use.

2. Acceptable Use

You agree to use the Service only for its intended purpose. You must not:

  • Submit false or fraudulent time entries
  • Attempt to manipulate location data or verification systems
  • Share your account credentials with others
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service

3. Location and Time Tracking

The Service uses location-based technology to verify presence at job sites. By using the Service, you consent to the collection and use of location and time tracking data as described in our Privacy Policy. Time entries and related data are accessible to your organization's management and may be used for payroll and workforce management purposes.

4. Intellectual Property

The Service, including its design, features, and content, is owned by WorkxPro. You are granted a limited, non-exclusive license to use the Service in accordance with these Terms.

5. Service Availability

We strive to maintain the availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

6. Limitation of Liability

To the fullest extent permitted by law, WorkxPro shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

7. Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

8. Termination

We may suspend or terminate your access to the Service at any time, including upon termination of your subscription or for violation of these Terms.

9. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of the province of Manitoba, Canada. Any disputes shall be subject to the exclusive jurisdiction of the courts of Manitoba.
